Encryption sits at the intersection of two ethical obligations that are easy to state and hard to reconcile: protect people’s private data and give lawful authorities the tools they need to investigate serious crime. For inventors, operators, and policymakers the question is not rhetorical. It is practical. The choices we make about encryption design and law will change how resilient our networks are, who can be protected by them, and who can be harmed by them.
In 2025 the policy ground is shifting in ways that make these tradeoffs painfully concrete. The European Commission published a ProtectEU roadmap that includes a Technology Roadmap on encryption and a push to improve lawful access to encrypted data as part of a broader internal security strategy. The ethical debate around encryption will not be settled in courtrooms or press releases alone. It will be settled in the protocols we accept, the audit regimes we build, and the institutional practices we enforce.
